Sabiedrības vajadzībām nepieciešamā nekustamā īpašuma atsavināšanas likums paredz nekustamā īpašuma atsavināšanu sabiedrības vajadzībām labprātīgā vai piespiedu kārtā, saņemot taisnīgu atlīdzību. Pētījuma mērķis ir analizēt labprātīgas un piespiedu nekustamā īpašuma atsavināšanas sabiedrības vajadzībām procesa ietekmi uz taisnīgas atlīdzības noteikšanu nekustamā īpašuma īpašniekam. Iegūtie rezultāti liecina, ka slēdzot līgumu par labprātīgu nekustamā īpašuma atsavināšanu sabiedrības vajadzībām, nekustamā īpašuma īpašniekam ir lielākas iespējas iegūt taisnīgu atlīdzību Sabiedrības vajadzībām nepieciešamā nekustamā īpašuma atsavināšanas likuma kontekstā.

The following article addresses the critical and controversial question concerning the invalidity of the transfer of immovable property not complying with urban planning regulation and the implication of this invalidity in the specific context of the preliminary contract. The paper comments an innovative and recent ruling of the Italian Supreme Court that proposes a crucial change in comparison with the previous decisions made in this matter. Author analyzes an interesting decision concerning a traditional topic of business law: the recognition of the distinguishing features between a tenancy of a business unit, on the one hand, and a lease of immovable property for nonresidential use, having a productive purpose, on the other.
